Whenever my spells fail, they recharge instantly.
Shame, Guilt, Mark of Subversion, and Spell Breaker.
Of course, things might have changed in a recent update that I never noticed, but otherwise, that's the way it's been for me.
Edit; Except for the X attribute or less 50% chance failures. Those have recharges when it happens.
