This is isn't true and never was (a couple minutes testing will trivially prove it's not true). It's one of these myths that got started and people keep repeating. In any case, at PAX this year I spent a while talking to the guy responsible for writing the hero AI (John Corpening), and the way it actually works is each skill is evaluated on its conditions but this still only provides a probability of being used. It does not work on a strict priority system, but instead is intentionally not deterministic, as he feels that makes things more interesting.
