Well, they can try, but you just can't patent certain things. It'd be like trying to patent something like the wheel or dice.

Auto Assault is essencially a GW on wheels.
PotBS devs, intentionally or not, are coping exact things GW devs said when GW was in design phase.
Even old good DarkFall vaporware is implementing GW like character progression system.
And seriously if Microsoft can patent iPod UI, I don't see a reason why A.net coudn't do the same.
Bottom line is, that GW indeed revolutionizes mmorpg industry - most games are dropping WoW like grind for uberness for GW like get it all, but equally powerfull. And instanced as hell.
