Supposedly you can switch anytime.
Our guild-alliance had 50,000 Kurzick faction rank-points and we were able to switched to Luxon w/o problems. We lost the 50k of course and instead got the default faction rank-point after switching (add the same amount for all alliance members you get the total amount for the whole alliance).

So maybe its a bug, and is affecting a few accounts only. Guild Leader accoutns to be exact.

This bug has nothing to do with how much faction you have left over.

Anyone who has answered my question on either side (working or not) has given data that supports that this bug is the following:
Invite a guild into your alliance, lose the ability (temporarily? permanently? until support looks at it? still not positive what got Kestral's guild freed up again, my guess is support) to change factions.

And yes, it goes both ways as Omega states having the problem going from Luxon to Kurzick.

I recommend you contact support as that seems to be the way Kestral's Guild got past this.

Edit: Also doesn't appear to be account based, considering Kestral and I both promoted several people to guild leader in an attempt to get around it, all to no avail.

From posting on various other sites, and talking to other ppl about it, it seems that If you have formed or been in an alliance, You can no longer switch, I talked to someone who Switched 2/3 times, then joined up as Kurzick with some friends, then thier friends wanted to switch, and couldnt, so they left the alliance, tried to switch and neither guilds could switch...

I think its a combonation of a few things in one.... -- Still waiting on the latest info from support after I sent them screen shots (2 days ago)

Update:

We have been fixed and have transfered to Luxon.

I submitted the bug to Bug Reports (department of support) and it got transfered to Quality Assurance. I sent in an e-mail to keep the ticket open over the weekend, and because I was confused. Bug Reports told me that Quality Assurance would be the department that could fix the problem (without a patch) if it was possible. Seems like it as the problem now seems to be fixed for us at least...

I already posted this in Q&A but no ideas so far. So we have an alliance of 3 guilds that we made as soon as factions were out. All 3 guilds had kurzick standing but a few days ago it turned into N/A. the leading guild cant invite any more guilds and we cant donate faction for the alliance either. The kurzick ambassador says my guild is already aligned with the kurzicks but the faction transfer npc says i should go talk to the ambassador to align the guild to the kurzicks (!?)

If my friend talks to the faction transfer guy (who is actually the leader of the alliance leader guild) he can tick an option to donate faction but it does nothing after. And before You ask he had enough kurz faction to donate when he checked. The 3rd guild has the same problems and we cant be invited by any other guild either .

Its not exactly the same bug but may have something to do with it?

Interesting.. I actually send the support team a bug report and they said "The development team is already aware of this issue and it will be fixed. Check for latest updates on guildwars.com."

As to when they actually fix it... no idea.
