i've heard you cap it in the last mission, but i won't be charming it, i find it rather appalling. IMO black widows are better looking. But in case you didn't know, all pets have the same stats given that they are both evolved the same way.
Aggressive --> Dire or Elder
Playful --> Hearty or Elder
Aggressive = +1 Damage / -30 Health
Dire = +2 Damage / -60 Health
Playful = -1 Damage / +30 Health
Hearty = -2 Damage / +60 Health
Elder = Normal Damge / Normal Health
Therefore a dire black widow and a dire pheonix would be considered equals apart from their obvious looks

I've beaten Factions, and yes, that's the only palce to cap the phoenix. It's a small explorable right after the last mission and movie, and there's something like 6-7 of them roaming about. So long as someone doesn't go on a phoenix killing rampage (as I've heard some players do) then there will be enough for everyone.
Also, Nivryx is correct, with the only exception being the Bears, as they have a skill (Brutal Mauling) that slows down their attack patern and doesn't add any damage.

yes, yes indeed brutal mauling slows down attacks, i thought about including that little tid bit but thought id keep it short and sweet, but now that we've mentioned that there are also some pets who do piercing damage and others do slashing damage. it still has to be looked into about the damage type of the factions pets - or at least last time i checked.

You do indeed capture the phoenix after the end of the final mission, so don't forget to take an empty charm animal with you if you want it.
The phoenix is only lvl 4 when you capture it though, so you will have the joys of levelling it to look forward to.
My phoenix is now lvl 20 and my only complaint is that it does not grow at all during the levelling process.
I noticed this too with my Reef Lurker (crab) that also did not grow at all from lvl 5 to level 20, whereas my Prophecies wolf doubled in size at least as it gained levels.
In fact, has anyone noticed if any of the factions pets actually get bigger as they gain levels like they used to in Prophecies?

Nope. My White Tiger stayed the same size from level 5 to level 20 and so far my Phoenix, now level 17, has not grown either.

The size isn't just from leveling, but from evolving. If you happen to have evolved an Elder pet, you'll see no size increase. Of course, some pet types show the size increases better and some poorer. In Prophecies the Stalker was notorious for not growing much while the Hog and Strider showed their growth much more clearly. With that said, the Factions pets do get the size increases for Dire and Hearty that Prophecies pets did, as I've seen screens of the larger variety pets. Which types show off their size better, I don't know yet.

Both my Phoenix and Reef Lurker were levelled to "Hearty" and level 20 and neither of them grew at all. I went back to the end of the game last night (in an attempt to get the banish point(s) for the map) and the level 4 Phoenix was exactly the same size. I am sure too that the Reef Lurker did not grow at all, in fact there was a thread here about that previously I believe.
Does anyone know what Factions pets do actually grow? I would suspect that cranes do, as they seem to start pretty small, but I don't really know as I have not levelled one yet. Perhaps that will be my next project.
This is just an observation as much as anything, as whatever their visual size on screen, they still occupy the same space when it comes to blocking/tanking etc. but it would have been nice to see them grow a bit though.
